Kayros AI ("we", "us", "our") is operated by Symon, an Australian-based sole trader. We are committed to protecting your personal data in compliance with the Thailand Personal Data Protection Act (PDPA), the Australian Privacy Act 1988, and the EU General Data Protection Regulation (GDPR) where applicable.

This Privacy Policy explains how we collect, use, store, and protect personal data when you visit our website (kayros.com.au), use our AI customer service platform, or interact with AI assistants powered by Kayros AI on our clients' websites and social media channels.

2. What Data We Collect

2.1 Website Visitors (kayros.com.au)

When you visit our website, we collect minimal data:

  • Browser type, device type, and screen resolution (via essential analytics)
  • Pages visited and time spent
  • Your name and email if you voluntarily submit a contact form or book a consultation

We do not use tracking cookies, advertising cookies, or third-party analytics tools that create user profiles.

2.2 AI Chatbot Users (on our clients' websites/social media)

When you interact with an AI assistant powered by Kayros AI on a client's platform, the following data may be collected:

  • Your name and contact information (if voluntarily provided during conversation)
  • The content of your messages and inquiries
  • Language preference
  • Booking and appointment details
  • Timestamp and channel of communication (website, Instagram, LINE, WhatsApp, etc.)

This data is collected for the purpose of answering your inquiry, booking appointments, and providing customer service on behalf of the business you are contacting.

3. How We Use Your Data

We use personal data exclusively for:

  • Responding to your customer service inquiries
  • Booking appointments and capturing leads on behalf of our clients
  • Improving AI response accuracy and quality
  • Sending consultation booking confirmations (if you book via Cal.com)
  • Complying with legal obligations

We never sell, rent, or share your personal data with third parties for marketing purposes.

5. Cross-Border Data Transfers

Your data may be processed outside of Thailand. Specifically:

  • Stammer.ai — servers located in the United States
  • OpenAI — servers located in the United States
  • Kayros AI — operated from Australia

In accordance with PDPA Sections 28–29, we ensure appropriate safeguards are in place for cross-border transfers, including contractual data processing agreements with our sub-processors. By consenting to our data collection (via the chatbot welcome flow), you acknowledge and agree to this cross-border transfer.

6. Data Retention

  • Chat conversation logs: Retained for 12 months from the date of conversation, then automatically deleted
  • Contact information: Retained for the duration of the business relationship between Kayros AI and the client, plus 30 days after termination
  • Website analytics: Aggregated, anonymized data retained indefinitely; individual session data not stored
  • Consultation bookings: Retained for 24 months for business records

7. Your Rights

Under PDPA, GDPR, and the Australian Privacy Act, you have the right to:

  • Access — request a copy of your personal data
  • Correction — request correction of inaccurate data
  • Deletion — request deletion of your data ("right to be forgotten")
  • Withdraw consent — withdraw your consent at any time
  • Data portability — receive your data in a structured, machine-readable format
  • Object — object to processing based on legitimate interest
  • Restriction — request restriction of processing in certain circumstances

8. Cookies

Our website uses only essential cookies required for the website to function (e.g., language preference, cookie consent status). We do not use:

Essential cookies are stored in your browser's localStorage and do not contain personally identifiable information.

  • Cloudflare security headers (CSP, HSTS, XSS protection)

  • Data processing agreements with all sub-processors

10. Data Breach Notification

In the event of a data breach that poses a risk to your rights and freedoms:

  • We will notify the relevant Data Controller (our client) within 72 hours
  • The Data Controller is responsible for notifying the PDPC (Thailand) and affected individuals as required by law
  • For website visitors whose data is directly controlled by Kayros AI, we will notify affected individuals and the relevant authorities within 72 hours

11. Children's Privacy

Our services are not directed at individuals under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected data from a minor, we will delete it promptly.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via a notice on our website. The "Last updated" date at the top of this page reflects the most recent revision.
