Terms of Service

These Terms of Service ("Terms") govern your use of the Kayros AI website (kayros.com.au) and our AI-powered customer service platform ("Service"). By accessing our website or engaging our services, you agree to be bound by these Terms.
Kayros AI is operated by Symon, an Australian-based sole trader ("we", "us", "our"). Our clients ("you", "Client") are businesses that subscribe to our AI customer service packages.
1. Scope of Service
What we deliver:
- AI-powered customer service assistant configured for your chosen communication channels (website chat, Instagram DMs, LINE, WhatsApp, Facebook Messenger, and/or TikTok DMs)
- AI trained on client-provided data including services, pricing, FAQs, and booking processes
- Multilingual response capability (languages as per your selected package)
- 24/7 automated customer inquiry handling, lead capture, and appointment booking
- Monthly performance reporting (Growth, Pro, and Enterprise tiers)
- Ongoing content updates within the limits of your package tier
What we do not deliver:
- Guaranteed sales, revenue, or specific business outcomes
- Custom software development or proprietary platform builds
- Medical, legal, or financial advice via the AI assistant
- Management of your social media accounts, advertising, or content creation (unless purchased as a separate add-on)
2. AI Accuracy Disclaimer
The AI assistant provides responses based on information supplied by the Client. Kayros AI does not guarantee the accuracy, completeness, or reliability of AI-generated responses.
The Client is responsible for:
- Providing accurate and up-to-date business information (services, prices, hours, locations)
- Reviewing and approving all AI assistant content before go-live
- Promptly notifying us of any changes to their business information
Kayros AI is not liable for incorrect responses resulting from outdated or inaccurate information provided by the Client, or from the inherent limitations of AI language models.
3. Data Processing
Data processing is governed by our Privacy Policy and complies with PDPA (Thailand), the Australian Privacy Act 1988, and GDPR where applicable.
In the data processing relationship:
- The Client is the Data Controller — responsible for the lawful collection and use of their customers' data
- Kayros AI is the Data Processor — processes data on behalf of and under the instructions of the Client
Our data processing commitments:
- Process data only as instructed by the Client and as necessary to deliver the Service
- Implement appropriate security measures to protect personal data
- Notify the Client within 72 hours of becoming aware of a data breach
- Delete all Client data within 30 days of service termination
- Provide data export within 14 days upon Client request at termination
- Not sub-process data to additional parties without prior notification to the Client
Cross-border transfers: Client data is processed by Stammer.ai (USA) and OpenAI (USA). By subscribing to our Service, you acknowledge and consent to this cross-border transfer. See our Privacy Policy for full details.
4. Payment Terms

| First month fee | 50% of the regular monthly rate (Lite ฿2,500 / Growth ฿7,500 / Pro ฿17,500). Payable at signup via Stripe, PromptPay, or bank transfer. |
| Monthly fee (Month 2 onwards) | Full monthly rate (Lite ฿5,000 / Growth ฿15,000 / Pro ฿35,000). Charged automatically on the same date each month, beginning 30 days after AI assistant go-live, unless the Client has cancelled before that date. |
| Cancellation during Month 1 | Client may cancel at any time. The 50%-off first month fee is non-refundable but no further charge applies. Cancellation must be submitted in writing to support@kayros.com.au. |
| Late payment (7 days) | AI assistant paused. Client notified. |
| Late payment (14 days) | AI assistant disabled. Service suspended until payment received. |
| Currency | Invoiced in Thai Baht (฿) or Australian Dollars (AUD) at Client's preference. |
All prices are exclusive of applicable taxes. The Client is responsible for any local tax obligations.
5. Term & Cancellation

- The 50%-off first month fee is non-refundable. If cancelled during Month 1, no further charge applies.
- Cancellation notice must be submitted in writing via email to support@kayros.com.au
6. Intellectual Property
Client owns:
- All FAQ content, brand assets, and business information provided to us
- Customer data collected through the AI assistant (as Data Controller)
Kayros AI owns:
- AI assistant configuration, prompt templates, and conversation flow designs
- Industry playbooks and knowledge base structures
- All proprietary tools, processes, and methodologies
Kayros AI retains the right to use anonymized, aggregated performance data in case studies, marketing materials, and product improvement — with Client's written permission.
7. Limitation of Liability
Total liability is capped at one (1) month's service fee paid by the Client at the time the claim arises.
Kayros AI is not liable for:
- Data breaches caused by Client negligence (e.g., sharing platform credentials)
- Third-party platform outages (Stammer.ai, OpenAI, Instagram, LINE, WhatsApp, Facebook, TikTok)
- Indirect, consequential, or incidental damages including lost revenue, lost customers, or business interruption
- Inaccurate AI responses resulting from incorrect information provided by the Client

Uptime commitments exclude scheduled maintenance (communicated in advance) and outages of third-party platforms beyond our control.
9. Termination Effects
Upon termination of the Service:
- AI assistant disabled within 7 days of the effective termination date
- Client data exported within 14 days if requested by the Client
- All Client content and customer data deleted within 30 days of termination (per PDPA requirements)
- Kayros AI retains anonymized performance data and proprietary configurations
10. Acceptable Use
Clients agree not to use the Service to:
- Distribute spam, malware, or fraudulent content
- Collect personal data without appropriate consent
- Provide medical, legal, or financial advice through the AI assistant
- Violate any applicable laws, including PDPA, consumer protection laws, or advertising regulations
- Misrepresent the AI as a human operator (the AI must be identifiable as automated)
11. Modifications to Terms
We reserve the right to modify these Terms. Material changes will be communicated to active Clients via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing Law & Disputes
These Terms are governed by the laws of South Australia, Australia. Any disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of South Australia.
For Thai-language versions of these Terms (if applicable), the English version shall prevail in case of discrepancy.
